– According to Cricket Administration Act
Mr. Drubahadur can be President of the Guyana Cricket Board (GCB) for three consecutive two- year term but he, or any other GCB President, can never be a Director of the WICB.
Article 17 of the government drafted GCB Constitution states:
“The Board shall be represented at meetings of the West Indies Cricket Board (WICB) by the President and either the Chairman of the Cricket Development Committee or the Chairman of the Senior Selectors. While the President shall be an automatic representative, the second representative and the Alternates shall be appointed by the Executive Committee and those appointments shall be made only after the full complement of the Executive Committee has been put in place”.
“The GCB representatives to the WICB general meetings shall endeavour to obtain the agenda for every upcoming WICB general meeting, and shall ensure that the Executive Committee is fully informed in order that it may advise itself as to the appropriate steps to be taken in preparation for the meeting, including holding planning meetings. The representatives to the WICB meeting shall present full reports including minutes and financial statements to the Executive Committee of the GCB not later than ten days after the WICB general meeting, which shall in turn present those reports and minutes to the general membership”.
No reference is made to the process for the appointment of GCB Member Directors to the WICB.
One cricket official observed that Mr. Claude Raphael, when he was on the GCB Executive, served simultaneously as Chairman of the Cricket Development Committee and Chairman of the Senior Selectors’ panel, so this could also have been an automatic appointment.
Yet again, it appears as though the Government of Guyana failed to acknowledge the changing governance structure of the West Indies Cricket Board. In 2012 the “Wilkins Report” recommended that no WICB director can represent their territories at General Meetings as this would affect their independence at the body’s corporate level. This recommendation was accepted and the Articles of Association of WICB was amended to reflect same.
A senior official of the GCB said that the correct constitution of the Organisation properly addresses this issue but the Government produced constitution appended to the Cricket Administration Act fails to recognise this important governance issue.
The GCB official further stated that their (GCB) presentation to the Parliamentary Select Committee addressed this discrepancy but the drafters of the bill failed to make any corrections.
