A West Berbice businessman has been ordered by the court to pull down a structure
which was deemed illegal after the relevant authorities were able to prove that the businessman failed to comply with the regulations pertaining to the construction of such building.
According to the regulation, persons wanting to erect any structure for residential purpose, or for conducting business, must submit a plan for approval by the relevant authorities.
The property owner must also adhere to the regulations which state that any building should be at least four feet from boundary of the lot on which the building is situated.
Ramdeholl Bisoondat and his wife Aishwarie Budhu, of 18B, Public Road, Bath West Coast Berbice, were taken before the court, accused of building without permission: contrary to the Public Health Ordinance.
The particulars of the offence state that Ramdeholl Bissoondat and Aishwarie Budhu on May 4, 2016, did erect a building on Parcel 170, Bath Settlement, West Coast Berbice, in the Bath/Woodley Park Neighborhood Democratic Council, without written approval from the local sanitary authority.
The defendants had entered a plea of not guilty. However, Magistrate Rhondel Weever subsequently ruled that the defendants were guilty as charged, when they returned to court on November 30, last. The court ordered that the building, which was erected in contravention of the Public Health Ordinance, be forthwith taken down.
If the defendants fail to comply with the order of the court, then the relevant authority may cause the said building to be taken down, and recover the cost incurred from the defendant or owner.
