A voir dire is being conducted before Justice Navindra Singh to determine the admissibility of the Caution Statement (CS) obtained from murder accused, Troy Green.
Green, a labourer from Holmes Street, Georgetown was indicted for the murder of West Coast Demerara, hairdresser Bibi Rafeena Saymar.
His trial is ongoing before Justice Singh and a mixed 12-member jury at the High Court in Georgetown.
Saymar, who was called ‘Amanda’, was butchered at her Hague, West Coast Demerara apartment on May 9, 2010. She was stabbed 11 times about her body by a lone intruder and died before receiving medical attention.
The woman’s husband, Dennis Persaud, a Canada-based Guyanese businessman had been detained for the murder. There were reports that Persaud had hired a hit man to kill his wife.
However, the case against the Canada-based Guyanese was thrown out, with Chief Justice (Ag) Ian Chang ruling that the court lacked sufficient evidence to charge him. Persaud was subsequently freed.
In his brief testimony before the court yesterday, Police Witness Detective Sergeant, Paul Wintz told the court that he assisted with the investigations relating to Saymar’s murder.
Wintz, who was stationed at the Leonora Police Station at the time, recalled that he obtained a CS from the accused.
The Policeman told the court that he had procured the statement from Green after cautioning him in accordance with the law.
Wintz said that the taking of the CS was conducted in the presence of another Police Officer, who signed it at the end of the exercise. The Detective further noted that no form of inducement or force was used against the accused while obtaining the statement.
However, based on legal submissions made by Defence Attorney, Peter Hugh, a voir dire is being done in the absence of the jury.
Last week, Joseph Cummings and Sherema Madramootoo, former neighbours of the victim, were called upon to testify by State Prosecutor Mercedes Thompson.
Both, Cummings and Madramootoo recalled that they heard loud noises coming from the apartment the 23-year old businesswoman and her reputed husband had occupied, in the wee hours of the morning of the incident.
The businesswoman was allegedly attacked at around 2:00 am.
The witnesses recounted an injured Saymar was found lying on her bedroom floor in a pool of blood after her apartment was invaded.
