A minibus operator who reportedly cuffed another man several times to the face because he had spoken inappropriately to his wife was released on bail after facing a charge at the Georgetown Magistrates’ Court on Friday.
Imtiaz Baksh, of Grove New Housing Scheme, East Bank Demerara, appeared before Magistrate Judy Latchman charged with assault causing actual bodily harm.
The charge against him detailed that on September 23, last, at Water Street, Georgetown, Baksh unlawfully assaulted Jonathan Moonsammy, so as to cause him actual bodily harm. Baksh pleaded not guilty and submitted an application for minimum bail through his lawyer, Haymant Ramdhani.
In his bail petition, the lawyer explained that Baksh’s wife was in a minibus and Moonsammy was being “very vulgar” in his speech towards her. Khan explained that his client asked the younger man to desist from doing so, but he didn’t.
According to the lawyer, Moonsammy instead turned around and assaulted his client who received injuries. He said that the defendant obtained a medical which shows the injuries he had sustained.
Ramdhani said that Baksh, a married man with three minor children, had never been charged before and was not a flight risk.
Police Prosecutor, Kerry Bostwick explained, however, that both men dealt cuffs to the each other’s face. He said the cuffs resulted in Moonsammy having a swollen gum and the outside of his mouth.
Moonsammy, a 24-year-old Herstelling, East Bank Demerara resident, was charged with using abusive language towards Baksh. He explained that the incident occurred around 15:30 hours that day. He said that they were at the bus park when the bus he was working on “dropped back li’l bit and hit he (Baksh) number plate. It ain’t break or scratch but we give he $1200 to buy back one, but he didn’t want that.” He claims that Baksh cursed him.
Police Prosecutor, Sergeant Vishnu Hunt offered no objections to bail for either of the men, who both denied the charges.
Moonsammy and Baksh were granted bail in the sum of $20,000 and $80,000 respectively. Their case will be called again before Chief Magistrate Priya Sewnarine-Beharry tomorrow.
