City Magistrate Fabayo Azore got expressions of profound appreciation from murder accused Delon Henry.
She had just imposed a four-year prison term on him following a conviction for the possession of illegal firearm and ammunition.
Henry a/k ‘Nasty Man’ of Lot 53 Houston, Housing Scheme, East Bank Demerara was found guilty of having a .38 revolver in his possession on October 2, 2015 at Agricola when he was not in possession of a firearm licence. He was also found guilty of having eight .38 rounds of ammunition.
At yesterday’s court hearing, the Magistrate informed Henry that she relied on the prosecution witness Police Corporal, Derwayne Eastman, who testified that he arrested Henry after finding the items in his possession.
Henry who is currently on remand for the murder of East Ruimveldt footballer, Dexter Griffith, was sentenced to two years jail on each charge and was ordered to pay a total fine of $100,000.
The prison terms will run concurrently.
Last month, Henry was committed to stand trial for the murder at the next sitting of the Demerara Assizes.
After being informed that he was found guilty of the offences, Henry emotionally professed his innocence and told the court that the gun and ammunition were not found on him. He maintained that he was being victimized, and stated that he never had the opportunity of gaining employment.
He stood muttering in the prisoner’s dock and appeared in disbelief while nodding his head. In mitigation, Henry explained that he has been in and out of prison since the age of sixteen for serious offences such as murders and robbery under-arms. He added that he was only released from prison last October after being on remand for nine months on robbery charges.
He claimed that officer Eastman was a “lying police.”
He asked the Magistrate to explain the basis for finding him guilty. The police never produced fingerprint evidence in the trial.
Eventually, he calmed down after the Magistrate informed him that she would impose the minimal sentence for the offences and impose a fine. He continuously thanked her and left the courtroom in all smiles. The murder accused told the court that he was strong and will survive in prison despite his petite structure.
According to the Magistrate, Eastman had testified that he received certain information and went on patrol in Agricola where he saw Henry acting in a suspicious manner on the western side of Brutus Street, Agricola. The Magistrate recalled that the police officer had testified that he recognized Henry who began to run when he saw him.
Azore related that Eastman told the court that he gave chase to Henry in a police vehicle and caught up with him at Romulus Street, Agricola. Azore stated that the lawman related that Henry told him he was not the holder of a firearm licence and that he was walking with the gun to protect himself because his life was under threat.
When Henry was called to lead a defence, he testified that he was being victimized by Corporal Eastman over an altercation he was involved in with a male friend of the officer. During his unsworn testimony, he stated that he was beaten by police and told that he was wanted for questioning in relation to a murder.
