Local contracting firm BK International and its Chief Executive Officer Brian Tiwarie have moved to the High Court seeking damages in excess of $100,000 from the National Media and Publishing Company Limited, Publisher of the Kaieteur News, over a letter titled “Brian Tiwarie-Golden Arrow of cheating”.
In a writ filed last week, Tiwarie, through his attorney Vidyanand Persaud is claiming that statements contained in the article constitute an atrocious libel which is wholly unjustified and which will inflict serious and irreparable injury to him and his company.
Tiwarie is also seeking an injunction restraining the publishing company and its servants from repeating and/or publishing any similar defamatory statements concerning him and his company.
A letter published by the Kaieteur News dealt with an agreement between Tiwarie’s company and Puran Bros. over the running of the Haags Bosch Landfill Site.
Tiwarie in his affidavit said that the letter falsely stated that a contract signed and confirmed between Puran Bros. and Tiwarie provided that both parties shall share in the running and management of the landfill site on a 20%-80% ratio and that numerous attempts by Puran Bros. to contact Tiwarie concerning the improper sole receipt of monies disbursed under the contract by Tiwarie were to no avail.
“I have suffered humiliation, injury and damage to my character and the second named plaintiff (BK International) has suffered loss of goodwill and damage to its business character as a result of the false and malicious publication,” Tiwarie said.
He said that the letter also amounts to comments on the merits of a pending legal action in the High Court instituted by Puran Bros. and is calculated to prevent a fair trial, which he stated is tantamount to contempt of court.
