Chief Justice Ian Chang yesterday ordered the release of the canter truck which was impounded by Police during protests over the fatal police shooting of Patentia schoolboy Kelvin Fraser.
Chang, by way of motion, directed the release of the vehicle which was impounded during protest action outside of the Brickdam Police Station and Ministry of Home Affairs.
The owner of the truck, Manniram, through his lawyer, attorney at law Robert Corbin, filed an Order of Rule Nisi of Mandamus. The order which was granted yesterday morning commanded the Commissioner of Police Henry Greene to deliver forthwith to the applicant.
Kaieteur News understands that the order was served on the Commissioner and another copy had to be served on the Commander of ‘A’ Division George Vyphuis. However the copy for Vyphuis was not served since his secretary continuously told the court marshals that he was in a meeting.
However it was only after the intervention of Manniram’s attorney, social activist Mark Benschop and Columnist Freddie Kissoon, late yesterday afternoon that the police finally decided to hand over the vehicle.
Speaking with Kaieteur News outside of the station, Manniram said that he did not wish to speak any further since he was afraid of victimization. He expressed thanks to his lawyer Robert Corbin, Freddie Kissoon and Mark Benschop.
Kaieteur News columnist Freddie Kissoon yesterday said that the only explanation for the vehicle being impounded was political. Kissoon opined that certain forces want to use the driver of the vehicle as an example – they are simply telling people that they should not lend support to persons of the opposition. He further told this newspaper that he and Mark Benschop would be compensating the truck owner for the income he lost.
“What the state did was totally wrong, he was victimized, and we have undertaken the responsibility to give him back his income that he lost” Kissoon said.
