Dear Editor,
Reference is made to M. Maxwell, “The 1980 constitution was not developed by the people,” Stabroek News, 5 December, 2014. For someone who said that he is no constitutional expert or lawyer and discussions on the constitution should be left to lawyers he surely wants to continue constitutional conversation.
This is a nation of laws. The laws that we have today and which guide the society, inclusive of the courts, elected officials and GECOM, grew out of the Guyana Constitution. To have a new constitution, be it through referendum or otherwise, the current constitution and its attendant laws have to be applied.
This said, gentlemen, as he calls for a new constitution by arguing that the current is illegal, has more than once called on the government to honour the constitution he decries. What is clearly coming through in his writings is one of conflicting positions and this should be explained.
Having not forfeited my right as a non-lawyer to engage in constitutional discussions, Maxwell should provide for this nation how his call for a new constitution through referendum can be realised in the absence of the present constitution and its attendant laws.
