The case of Onika Luke, the 16 year old waitress who was shot while in the course of her duty at Lucky Star Chinese Restaurant at Better Hope, East Coast Demerara is an industrial accident pursuant to Section 22 (a) of the National Insurance Social Security Act Chapter 36:01.
It is presumed her employer may have failed to register her as an employed person and pay NI contributions on her behalf but those omissions should not deny her entitlement to injury medical care benefit. The conditions that accompany the employing of work-study students must apply in this case.
The district NIS inspector should be reactive and do his duty whereby the brother of the injured person will not be reduced to a mendicant soliciting assistance from the public and the Ministry of Indigenous Peoples Affairs.
The Injuries Onika suffered happened while she was within the scope of her work and what must be considered a risk incidental to her employment. Employment at a Chinese Restaurant now seems to be a hazardous occupation.
The employer, if he has met the medical expenses, may recover same from NIS if authorised by Onika to do so.
