“No one is above the law and thank you for showing us that.”
These were the words of Chief Magistrate Priya Beharry to Commissioner of Police Henry Greene when he appeared before her yesterday at the Georgetown Magistrates’ Court.
In what was a generally unexpected scenario, Commissioner Greene was
summoned before the court to defend the police’s continued possession of a motor car which ranks had seized several months ago.
In a private action against the police, in which the commissioner was named as the defendant, Uland King, is seeking the return of her car, a Toyota Raum.
In an application filed in the court, King alleges that on March 31, last, the police seized her car in connection with a criminal matter.
The matter is in relation to a robbery under arms committed on the East Bank of Demerara.
However, according to court documents, no charge was proffered in relation to the seized vehicle and King is accusing the police of depriving her of her car without due process. She is asking the court to have the police show good reason for keeping her car.
When the matter was called up yesterday, Court Superintendent Maxine Graham and District Detective Officer, Superintendent Marlon Chapman attempted to represent the police, but this was objected to by the Magistrate, who pointed out that the named defendant was the Commissioner of Police.
She set a time for the appearance of the Top Cop, pointing out that no one was above the law.
Sure enough, the Commissioner presented himself before the court, and prevented a potentially ugly situation of an arrest warrant being issued for him.
The matter was however put down for September 28. (Dale Andrews)
