DEAR EDITOR,
As I read the Monday, 19 March 2012 dailies, several of which headlined, ‘Boat crash survivor yet to be compensated’ … ‘seeks new legal team to collect a huge sum of money owed to him’, it dawned on
me that I am in a very similar position, though for a much smaller sum.
In December of 09’, one of our ‘ever-in-a-hurry’ minibus drivers crashed into my car. Our court dates were called and this driver was found liable and was eventually ordered to me pay a sum G$100,000 to bring closure to the matter – after MY comprehensive coverage ASSISTED with repairs of course.
The trouble is, this unconscionable man paid me G$25,000 in court and was never to be seen or heard of again. I called him once to query the status of the Magistrate’s order and was frankly told, “You could do
what you want; I don’t have time with that!”
I am certain that there are several others in the same predicament, much like this gentleman and I. The question therefore begs, what should be our next course of action? Should we incur an additional cost to seek legal representation for a case on which a Magistrate or Judge already presided? Should we sacrifice more time, for as we are well aware, these matters move quite slothfully?
It is really unfair for people to be twice a victim of the same crime – once of the perpetrators and secondly, of the justice system. I wish some legal mind would respond to this letter and give me some advice, for I’ve reached saturation point and I’ve lost all faith in this country’s justice system.
