Kaieteur News – A 57-year-old murder accused was freed on Monday after the Magistrate upheld a no-case submission put forward by his attorney.
Sarjoo Matadin left the Fort Wellington Magistrates’ Court a free man after Magistrate Peter Hugh upheld a no-case submission made by his attorney Murseline Bacchus, SC.
Matadin, a cash crop farmer of Bath, West Coast Berbice (WCB) was among three other men accused of murdering overseas based businessman Mohamed “Raymond” Haniff back in September 2020 at his Lot 56 Experiment, Bath Settlement, WCB.
The other accused are 29-year-old Royston Dowden of Waterloo, Bath; 50-year-old Devon McCalmon of No. 22 Village and 21-year-old Ivan Lindo of Waterloo, Bath.
Attorney Bacchus, in his no-case submission, argued that the out-of-court assertion of one person cannot be used against another. While quoting several authorities to support his position, the attorney said that Inspector Narine’s evidence in the case was purely hearsay and overall inappropriate. The attorney posited that the mere presence of an individual at a crime scene doesn’t implicate him or her. Further, he submitted that the burden of proof doesn’t fall on his client but on the prosecution.
To the contrary, the prosecution told the court that it relied heavily on the evidence presented to the court.
Magistrate Peter Hugh after listening to the submissions of both the prosecution and defence concluded that a prima facie case was not been made out against the accused and discharged the matter.
Haniff was reportedly beaten with an iron bar and chopped multiple times with a cutlass during an invasion at his home. He was rushed to the Fort Wellington Hospital before being transferred to the New Amsterdam Public revealed that Haniff died as a result of multiple incised wounds to the head.
Haniff’s wife was also arrested but was subsequently released on station bail.
