Dawn Cush, Attorney-at-law and Director of Guyana Competition and Consumer Affairs Commission (CCAC), has disclosed that if there is no expressed warranty on the product, then the law implies a warranty of six months.
She said out that such products include electronics among others.
The law states, “Goods sold by a supplier to a consumer shall, in the absence of an explicit warranty, be deemed to have a warranty of six months on parts and labour.”
In an interview with Kaieteur Radio on the programme, Legal Mind, the Director explained that in the case of a product having an attachment of small period of warranty, for instance, three months is not applicable as it relates to the law.
Cush advised that if there is an issue with a product within the period of time that the warrant permits as some would constitute longer periods, then the consumer should take the product back to the supplier.
She explained that the warranty becomes void if the consumer tries to fix it on his/her own cost.
According to Cush, there has not been a substantial amount of complaints made to CCAC for reasons being perhaps people are not aware of their rights as it relates to warranties.
During the interview, Cush further added that other rights of consumers include the right to product information, right to a receipt among others.
The Guyana Competition and Consumer Affairs Commission (CCAC) is a statutory body that is established to deal with the Competition and Fair Trading Act and the Consumer Affair Act.
According to the Director, the CCAC only handles complaints regarding “durable goods and services”. She pointed out that food and drugs comes under Food and Drugs Administration, while the Public Utilities Commission deals with utilities. She further explained that the law does not provide the CCAC with the jurisdiction to deal with other complaints.
