An interesting legal battle is currently taking place in Britain which will determine whether British Prime Minister Boris Johnson acted unconstitutionally in dissolving Parliament mere weeks ahead of the October 30 deadline to exit the European Union. In essence, it represents a battle between the Executive arm of the Government and the Legislative arm which will now be decided by the Judicial arm. This is a clear case of the Judiciary holding the balance of power in the dispute between the other two branches of Government.
At the centre of the battle is Guyana-born Gina Miller, daughter of the late Doodnauth Singh, a former Attorney General under the previous PPP/C administration. She successfully won a case before the High Court challenging the decision of the government to trigger a withdrawal from the European Union without parliamentary approval.
It is interesting to see how this matter will play out at the Supreme Court. One thing is certain. Whichever way the ruling goes, it will be a defining moment in British politics.
Moreover, should the ruling of the High Court be upheld, this would be a severe blow for Prime Minister Boris Johnson who has vowed to leave the European Union ‘deal or no deal’ by the end of October.
This is a true test of the independence of the three branches of government, indicative of a matured democracy. This is unlike what is taking place in Guyana where the Executive ignores the decisions of the Judiciary with impunity.
