The accused in the murder trial of Edun Poultry farmer, Aga Khan, was freed yesterday after a mixed jury was directed to return a formal verdict of not guilty on his behalf.
Mahendra Bishundial was released after State Prosecutors Lisa Cave and Orinthia Schmidt closed their case and Justice Sandil Kissoon ruled in favour of a no case submission presented by his attorney Nigel Hughes. The State has indicated an intention to appeal the ruling.
Bishundial was facing a second trial at the High Court before Justice Kissoon for the murder. His first trial had ended in a hung jury.
As a result, Justice James Bovell-Drakes ordered a retrial at the High Court.
Bishundial had previously denied the charge which alleged that on November 6, 2012 at Busby Dam, Craig, East Bank Demerara, he murdered Khan during the course of a robbery.
A police release stated that Khan was attacked by four men, one of whom was armed with a handgun and others with knives. Khan was driving motor lorry GJJ 2806 owned by Edun Poultry Farms, east along Busby Dam, when the men walked into the path of the vehicle causing the driver to stop.
One of the men then approached Khan and demanded cash. He was shot to his neck in the process. Investigations were carried out and Bishundial was arrested and charged.
Earlier in the trial businessman, Saeed Edun told the court that Khan, a truck driver, was one of his employees. According to Edun, on that tragic day, Khan collected the keys to Canter truck GJJ 2806, while another employee uplifted the bill books and a cellular phone.
Edun said that around 17:00hrs that said day, he received a phone call from his wife which caused him to leave their home at Busby Dam, Craig, East Bank Demerara. The witness said that the Canter truck was parked along the Dam and he saw Aga Khan and another employee lying inside in a crouching position.
The poultry farmer recalled that he transported the injured men to the Diamond Diagnostic Centre, after which, he left for the Grove Police Station to inquired about what had transpired. He disclosed that a total of $48,000 was missing from the Canter truck.
One Mervin Marcus who was also employed with Edun Poultry Farm at the time of the killing, and a taxi driver also testified when the trial continued.
