One year after a truck driver was charged with causing the death of two brothers in a horrific accident at Friendship, East Bank Demerara, the matter was yesterday dismissed against him by a
City Magistrate.
It is alleged that Ganesh Ramdass, 27, of Tuschen, East Bank Essequibo, on October 1, 2016, at Friendship, East Bank Demerara, he drove motor lorry GNN5355, in a manner dangerous to the public causing the death of Jonnel and Phillip Armstrong.
Yesterday Senior Magistrate Fabayo Azore ruled that the evidence led by the prosecution witnesses was insufficient.
She added that the court did not find sufficient evidence against Ramdass so she upheld the no case submission by the defendant’s attorney, Paul Fung-a-fat.
The Magistrate added that after perusing the entirety of the evidence she found no evidence that the defendant was speeding on the day in question.
Throughout the trial Ramdass’s lawyer had always argued that the driver of the Rav4, lost control as he was negotiating a turn and ended up in the path of his client’s truck.
Ramdass was out on $200,000 bail pending the hearing and determination of the trial.
According to reports, the two brothers, formerly of Watooka, Linden, and a friend, were heading to Linden in a Toyota Rav4 when they collided with the truck that was heading in the opposite direction.
Reports are that the brother behind the wheel of the vehicle was reportedly speeding at the time of the accident.
The driver of the truck managed to swerve, but the Rav4 slammed into the side of the truck.
The brothers were pronounced dead on arrival at the Diamond Diagnostic Centre.
