One week after Police Prosecutor Shawn Gonsalves closed its case against a taxi driver who is charged with causing the death of a porter who was struck and killed in an accident on Kuru Kuru, Soesdyke/Linden Highway, the man’s lawyer made a no-case submission on her client’s behalf.
Sadath Newark, 28, is on trial before Principal Magistrate Judy Latchman in the Georgetown Magistrates’ Courts. It is alleged that on February 6, last, at Kuru Kuru, Soesdyke/Linden Highway, he drove motorcar PRR 378 in a manner dangerous to the public, causing the death of Dexter Conway.
He had pleaded not guilty to the charge on his first court appearance and was released on $1.5M bail.
Yesterday, Attorney-at-law Sonia Parag in making a no-case submission stated that her client should not be called upon to lead a defence in the matter. She added that the Prosecution is unable to prove their case beyond reasonable doubt and the matter against her client should be dismissed.
However, Prosecutor Gonsalves is contending that the defendant should be called upon by the court to lead a defence in the matter since there is sufficient evidence.
The Prosecution will reply to the lawyer’s no-case submission on September 4.
It was reported that on the day in question, Newark was proceeding east along the Soesdyke/Linden Highway when he collided with Conway who was standing at the side of the road.
The father of five, who resided at Old Road, Land of Canaan, East Bank Demerara, was flung onto the road’s surface. He was then picked up and rushed to the Diamond Hospital. He was pronounced dead on arrival.
It was reported that at the time of the accident, Elroy Savory was driving motor lorry GVV 427 with trailer TVV 87, while Conway was the porter.
Reports indicated that the lorry was proceeding east along the northern carriageway of the public road when it encountered a mechanical problem.
Conway and Savory exited the vehicle and positioned themselves along the right side of the vehicle trying to fix it, when they were struck down by motorcar PRR 378, which was proceeding in the same direction.
