Dear Editor,
Please allow an ardent and avowed fan of KN the space in your excellent paper to seek an answer to this question. This from an untrained legal mind but nonetheless with a genuine need to know. From time to time I’ve read where persons or perpetrators of an offence against another offers to pay compensation and as a result have the charge(s) against them dropped.
This question was prompted by the story in the Sunday Edition of KN detailing a young man charged with attempted murder for dealing another a good drubbing with a piece of wood against his head, and had the charges dropped after he offered compensation to the victim.
My confusion, a crime/offence was committed; of this there is no doubt. The Law was violated. Should that in itself not be a separate issue from compensation? Can anyone with the discretionary funds commit a crime against the person and compensate themselves out from under the resultant charges? Are these arrangements supervised by the court prior to the charge(s) being dropped?
And if not who is to say the perpetrators will honour their commitment? Finally, if the latter scenario becomes a reality are the charges reinstituted?
These are all questions swirling around my head since to my untrained legal mind a crime was committed; a law was violated. Shouldn’t that be addressed? Now if the victim refuses to testify against the perpetrator, I can see the prosecution not having a case but on the surface these compensation matters seem to be driven by paying ones way out of a difficult situation.
The young man during his court appearance was so violent the report states, it took five officers to calm him after he cuffed his sister in the face. Does anyone believe he will compensate the victim after the fact?
Help I need clarity!
