-as prosecution ordered to close case tomorrow
Despite Police Prosecutor Gordon Mansfield requesting an adjournment for a police witness to tender certain exhibits in the preliminary inquiry into the murder of schoolboy, Brian Yearwood, his application was denied by Principal Magistrate Judy Latchman.
In fact, Magistrate Latchman instructed Prosecutor Mansfield to call his final two witnesses—both civilians—to testify tomorrow or else he would have no other choice but to close the case for the state.
Magistrate Latchman set tomorrow as a peremptory date.
Andy Peters, 17, of Lot 224 B Kaneville, Grove, East Bank Demerara and Shannon Cox, 20, of Lot 261 Kaneville, Grove are currently on remand for the indictable offence which occurred on April 29, last, at Covent Garden, East Bank Demerara.
Nevertheless, three police witnesses, Inspector Hubert Henry, Corporal Kevin Hubbard and Constable Dookram were called to testify yesterday when the PI continued in the Georgetown Magistrates’ Courts.
Inspector Henry, who is the Officer in Charge of crime at the Ruimveldt Police Station, recalled visiting the crime scene on the day in question with other ranks when he discovered the body of Yearwood.
It was Corporal Hubbard, who told the court that he went to uplift the exhibits from the Guyana Forensic Science Laboratory but was told that they were not ready.
In the circumstances, Prosecutor Mansfield asked for the witness to be given time to uplift and tender the exhibits in court. However, Magistrate Latchman opposed noting that the prosecution is wasting time.
According to reports, Yearwood of Kaneville, East Bank Demerara was stabbed in the region of the heart during a scuffle allegedly by the two murder accused. The stabbing took place during a concert that was being held at the above mentioned school.
The police recovered a knife, which is suspected to be the murder weapon.
The teen was rushed to the Diamond Diagnostic Centre, but it was too late as he was pronounced dead on arrival. Kaieteur News understands that the killing stemmed from gang-related issues.
The two murder accused are said to be from one gang, while the 16-year-old victim was a member of another gang. The police said that Yearwood of Kaneville was preparing to sit the Caribbean Examination Council next year.
