Businessman, Thomas Pinkerton, is suing the Guyana Water Incorporated, (GWI) and his partner, James Samuel, over an alleged breach of agreement involving a contract.
He entered into an agreement with the water authority to mix, transport and supply to various well sites belonging to GWI, a liquid chemical used to eliminate iron from water.
In the lawsuit filed on September 15, last, Pinkerton is claiming that both parties owe him money under the contract.
In the claim filed by the businessman, he contended that James Samuels and himself are business partners, who entered into a partnership agreement.
He also contended that the two of them first entered into an oral agreement with GWI, which was represented by its Chief Executive Officer, Dr. Richard Van West Charles, to mix, batch, transport and supply liquid Seaquest to various Well sites with GWI purchasing and supplying to them the dry Seaquest.
Later, this agreement was set out in a written Agreement dated June 23, 2016. The Business Partners initially only supplied five wells at Ithaca, Agricola, Edinburgh, Clonbrook and Goed Fortuin, but later this was increased to 13 wells.
This contract was for a period of three months, but after this period had elapsed, they continued to supply the Seaquest to GWI.
Later, on December 30, 2016, the businessmen entered into another contract with GWI to continue supplying the liquid Seaquest.
Thomas Pinkerton is contending that he has not received any money under these contracts even though the Seaquest has always been provided to GWI well sites; and the contract has not been terminated by GWI.
It appears that GWI may have been paying Samuels monies under this contract to the exclusion of Pinkerton., who is therefore claiming damages in excess of $7 million against the two named defendants.
He alleged that before filing the claim through his Attorney-at-Law, Lyndon Amsterdam, he attempted to resolve this matter by making personal interventions to the Chief Executive Officer of GWI and to his business partner.
He even caused his lawyer to write to both parties, but all his efforts have proven futile and they continue to ignore him.
The documents were therefore filed on behalf of Thomas Pinkerton and served on both GWI and James Samuels.
The liquid Seaquest is used by GWI to purify the water supplied by GWI to the residents of Guyana.
