Justice Priya Sewnarine-Beharry dismissed an injunctive application filed by former Attorney General Anil Nandlall. She also ordered him to pay $30,000 in costs. The judge found that no interim order was made.
Nandlall had moved to the court to stop Attorney General Basil Williams from instituting charges against him for the Commonwealth Law Volumes removed from the Office of the Attorney General. Nandlall had gone to the courts, earlier, with an application but the court found that the filing lacked certain supporting documents and dismissed it.
Eleven days later Nandlall sought to reintroduce the same application but he did not make mention of the earlier application. He was seeking to mislead the court, lawyer for the Attorney General said.
The issue was what Nandlall termed defamatory statements by the Attorney General, Mr Williams, who had announced that he was going to charge Nandlall for stolen law books. By the time Nandlall moved to the courts the second time his application showed that there was no urgency, coming 11 days after the alleged statement.
Circumstances had also overtaken the action sought by Nandlall; the charges were already instituted. The court has also stated that there would be a case management conference on October 6, when a determination would be made on whether the substantive matter— the claim of defamation—is to be heard.
Attorney at Law Patrice Henry appeared for the Attorney General while Manoj Narayan appeared for Mr Nandlall.
