A taxi driver, who pleaded with the court to be lenient with him due to the fact that he is an asthmatic patient, and also suffers from hypertension and high cholesterol, was yesterday sentenced to four years imprisonment by Chief
Magistrate Ann McLennan, after he pleaded guilty to a charge of causing death by dangerous driving.
Fizal Mohammed, 53, on February 19, last, at Fort Street, Kingston, Georgetown, drove his vehicle (HC 358) in a dangerous manner, causing the death of Gregory Nedd.
Facts presented by Police Prosecutor Arwin Moore stated on the day in question, Mohammed was the driver of the aforementioned car which was facing south along the western side of Fort Street, Kingston.
The court heard that Mohammed went into his vehicle and reversed in a fast manner along the said road and collided with Nedd who was at the time sitting on a chair at the western corner of the roadway.
As a result, Nedd fell on the roadway. The man was then picked up by public-spirited persons who rushed him to the Georgetown Public Hospital where he succumbed to his injuries.
Mohammed told the court that on the day in question he was parked on the southern side of Fort Street after he had gone and purchased some food. The accused stated that after he got into his car he put the car in reverse, since there was another vehicle in front of him. As he put the vehicle in reverse, the brakes on the vehicle did not engage and he was unable to stop the vehicle from hitting Nedd.
Meanwhile, the prosecutor further stated that after the vehicle collided with Nedd, persons in the street managed to bring the vehicle to a stop. The court also heard that when Mohammed came out of his vehicle to render assistance to Nedd, he was assaulted by residents in the area which caused him to go back into his vehicle and seek cover.
The Prosecutor told the court that when Mohammed was arrested and given a breathalyzer test, it revealed that he had alcohol in his system above the normal limit.
