Embattled former Health Minister in the PPP regime, Dr. Bheri Ramsaran, and his team of lawyers are trying everything possible to keep the magistrate from handing down her decision.
For the third time a decision on the matter has been put back due to different reasons.
The matter which was scheduled for decision on Monday in the Whim Magistrate’s Court before magistrate Charlyn Artiga could not have been heard because the Magistrate was not allowed to make a decision because Dr. Ramsaran lawyers once again moved to a higher court to stall.
His team of lawyers has petitioned the Court of Appeal for a temporary stay order until the hearing of an appeal against a no case submission which they had made and was overruled by Magistrate Artiga.
The former Health Minister is accused of using insulting language towards Women’s Rights Activist, Sherlina Nageer on April 20, 2015, outside the Whim Magistrate’s Court.
Prosecutor Inspector Phillip Sheriff is presenting the state’s case.
Ramsaran’s lawyers had moved to the high court before Justice Nareshwar Harnanan to have the matter thrown out. The lawyers had stated that after perusing the documents their client is convinced that the prosecution hasn’t established the ingredients of the charge based on the statements that were supplied to the defence.
However that matter was dismissed and the trial continued in the Magistrate’s court.
The Prosecution’s case was conducted by Inspectors Althea Solomon, Bernard Brown and Phillip Sheriff at different stages.
The defence had put forward a no case submission. However, this was overruled by the magistrate who ordered that they lead a defence. The matter has been put down until November 21st.
