A 22-year-old man was sent to jail for four years by City Magistrate Judy Latchman, after he was found guilty by the court for the offence of robbery under-arms when he appeared in the Georgetown Magistrates’ Courts yesterday.
On February 21, James Alleyne, while on Middle Street, Georgetown, and armed with a knife robbed Lee Leung of a Blackberry cell phone and $440 cash.
During the summing up of evidence, the Magistrate told the court that she disbelieved Alleyne when he said that he saw the victim for the first time in court. Magistrate Latchman affirmed that she believed Alleyne used the knife to relieve Leung of the phone and money and that he intended to permanently deprive the victim of his belongings.
Based on evidence led by Police Prosecutor Kerry Bostwick, the Magistrate informed the court that she was satisfied that Alleyne feloniously appropriated the items mentioned in the charge.
Prosecutor Bostwick submitted that the case of robbery under-arms was proven beyond reasonable doubt. He asked the court to disbelieve the story told by Alleyne since he had made several attempts to mislead the court.
Bostwick therefore urged that the court find Alleyne guilty as charged while noting that the prosecution’s witnesses were truthful and maintained their stories under cross examination.
The convict, who had no legal representation, had elected to gave a sworn testimony when he was called on to lead a defence. He had testified that he was arrested and searched by two men in a motorcar who later placed him in the trunk of the vehicle.
He pleaded with the Magistrate to impose a light sentence on him and even offered to compensate the victim. However, Leung who was present in court refused the offer.
Alleyne also asked the Magistrate to impose a fine since he is the breadwinner of his family which consists of two minor children.
Having considered all mitigating factors, the prevalence of the offence and the need to prevent others from contemplating such offences, the Magistrate handed down her ruling which left Alleyne in a state of disbelief. He stood calmly in the prisoner’s dock in shackles and handcuffs and begged for the prison term to be reduced. But the Magistrate told him that her decision was final.
