A High Court motion has been filed as it relates to whether the Magistrate’s court can proceed with the trial of a man who was yesterday charged with being in possession of gold weighing in excess of 19 ounces when he had no export licence.
This matter is currently the subject at the Constitutional Court before Chief Justice (ag) Yonette Cummings-Edwards and will be heard again on April 14, following a motion file by Former Attorney General Anil Nandlall.
This is according to Attorney, Latchmie Rahamat who made a bail application on behalf of Richard Ramjit, 36, after a charge was read to him by Chief Magistrate Ann McLennan.
Ramjit filed a $10M lawsuit against the Government after he was detained at the CJIA.
Ramjit of Better Hope, East Coast Demerara, is accused of having the gold (in the form of jewellery) weighing 19.12 ounces carrying a value of $4, 150,000 in his possession on January 19, last, at the Cheddi Jagan International Airport (CJIA) without having an export licence.
It was further alleged that on the same day at the aforementioned airport, the father of one, failed to declared money in excess of US$10, 000.
Ramjit pleaded not guilty to both charges read to him in the Georgetown Magistrates’ Courts. He was ordered to post $100,000 bail and return to court on April 20, for reports.
Latchmie during a bail application informed the court that her client has no pending matters or previous convictions. Police Prosecutor, Corporal Deniro Jones was not opposed to the defendant being granted pre-trial liberty.
