Special Prosecutor, Nigel Hughes informed the court that the remaining police witnesses in the matter are expected to complete giving evidence next Monday (February 8).
Hughes indicated this after Police Sergeant Eon Jackson took to the stand to identify ballistic reports and spent shells, as the trial of the five men accused of robbing and terrorizing land court judge, Nicola Pierre, and her husband Mohamed Chand continued yesterday,at the Sparendaam Magistrate’s Court.
Sergeant Jackson is attached to the Criminal Investigation Department (CID), Ballistic Section, Eve Leary, Georgetown. He is an expert in firearm and ammunition examination. To date, Jackson has examined over 2000 firearms and 10,000 ammunition of various calibres.
Premnauth Samaroo; Damien Millington, 22, of Lot 118 Caesar Street, Agricola; Nicholas Narine, 18, also of
Caesar Street Agricola; Anthony David, 28 of 63 Hadfield Street, Stabroek and Warren Mc Kenzie, 22 of Lot 18 Brutus Street, Agricola are jointly facing three charges, two for the offence of robbery under-arms committed on Pierre and her husband and another for the offence of discharging a loaded firearm at security guard, Ron Peters.
They have all pleaded not guilty to the charges and are currently on remand.
The remaining police witnesses, including Assistant Superintendant of Police (ASP) Mitchell Caesar, were scheduled to take the stand yesterday. However, the court was informed by Prosecutor Hughes that the witnesses were performing other duties and would not be available until February 8.
Magistrate Zamilla Ally-Seepaul sitting in that court excused the lawmen and granted the adjournment.
According to Hughes, at the conclusion of their testimonies the court will commence a Voir Dire (trial within a trial) to ascertain the admissibility of caution statements and oral confessions given by the number three and four defendants (Millington and David).
Pierre, Chand and Peters have completed given their testimonies. They have so far, positively identified four of the defendants (Samaroo, Millington, Narine and McKenzie) as the ones who were part of the robbery/invasion that occurred on July 9, last, in the gated community of Felicity, East Coast Demerara.
According to reports, heavily-armed bandits inflicted a brutal beating on the Land Court Judge and her husband after overpowering on-duty Special Constable, Ron Peters before storming the couple’s home.
The couple was attacked while they were asleep. They were gun-butted into unconsciousness after the men, gained entry to their home via a window.
The robbers carted off a small safe containing US$7,000, jewellery, and a suitcase containing other valuables. But they were forced to drop their loot after coming under fire from a security guard who was stationed at a businessman’s home nearby.
Pierre sustained a broken jaw and other injuries, while her husband received severe injuries to his right eye. He has since lost the eye.
