Police have been very proactive within recent days in conducting drug raids around the city. This has resulted in scores of persons being arrested and charged for trafficking.
One such individual was 25-year-old Junior Maloney, of Vryheid’s Lust, East Coast Demerara. His stall at ‘Donkey City’, Stabroek Market was searched by police, who allegedly found a quantity of marijuana.
Yesterday, Maloney was arraigned before City Magistrate Ann Mc Lennan at the Georgetown Magistrates’ Courts, after being slapped with a drug trafficking charge.
Compelling bail objections, made by Police Prosecutor Corporal Deniro Jones, resulted in him being remanded to prison.
It is alleged that on July 29, at Donkey City, Stabroek Market, Maloney had 53 grammes of cannabis in his possession for the purpose of trafficking.
He pleaded not guilty to the charge.
Prosecutor Jones told the court that on the day in question, police went to a stall at Donkey City, where they saw the defendant throwing something on the ground concealed in a black plastic bag.
Jones noted that the police retrieved the bag and found a quantity of leaves, seeds and stems inside suspected to be cannabis. He pointed out that at the time of the search the area was cordoned off and the defendant had no place to evade the lawmen.
The prosecutor added that the illicit drug was also weighed in Maloney’s presence and amounted to the amount mentioned in the charge.
Subsequently he was arrested and the charge was instituted.
Maloney’s lawyer, Adrian Thompson, asked the magistrate for his client to be granted reasonable bail. In doing so, he argued that special circumstances arose in relation to the charge.
The attorney contended that his client is being victimized because he is “Rasta”. Thompson explained that the police placed several persons in custody after the raid and showed them a plastic bag. He also pointed out that the police are alleging the same offence against the other persons.
Further, he contested that the police cannot establish a nexus between his client and the drugs because it was not found in his possession.
This matter will be called again on August 17.
