Kiskino Williams was sentenced to 11 years in prison yesterday after he pleaded guilty to setting fire to a house, which led to the death of five year- old Joy Singh, his niece. The incident is said to have occurred at 8 Mile Backdam, Port Kaituma, Region One.
According to the allegation, Williams called “Kiski,” 36, of Port Kaituma, Region One is said to have murdered Singh on October 11, 2006. The accused was also indicted for setting fire to a dwelling house with intent. He pleaded guilty to the lesser count of manslaughter and the other two arson offences.
The incident is said to have occurred during a drunken brawl between Williams and his brother.
The facts of the case stated that during the altercation, Williams chopped his brother before he locked him and other relatives in the house and set it ablaze.
The house was located on a mining camp in Port Kaituma. Williams’ brother and three children were among the occupants asleep in the burning building. The children were identified as 5 year- old Joy Singh, 13 year- old Tolly Singh and six year old Justin Singh. The latter two managed to escape death but also suffered grave injuries.
Williams’ case commenced on Thursday after a jury was empanelled before Justice Navindra Singh at the Georgetown High Court. He had initially pleaded not guilty to the charges but changed his pleas and begged the court for leniency when he stood before the court yesterday.
Williams told the court that he had been incarcerated for nine years and that he is sorry for what happened. He also noted that he had not premeditated the act.
“I asking you to have mercy on me sir,” the accused beseeched the court.
His Attorney, Debra Kumar in her plea of mitigation, noted that her client, who had been behind bars awaiting trial for the past nine years, did not wish to waste the court’s time.
Kumar also pointed to the fact that the accused used no personal violence on the victim, who was 5 years old at the time of her demise.
“The cause of death was determined as burns,” Kumar noted. The Attorney also informed the court that her client is a father to a fifteen year- old daughter, who expresses deep remorse for the incident and is throwing himself at the mercy of the court. Kumar asked the court to take into consideration that her client was at the time under the influence of alcohol.
Meanwhile, State Prosecutor, Narissa Leander asked the court to consider that the victim was a child. Leander worked in association with Assistant Director of Public Prosecutions, Judith Gilharie- Mursalin.
In handing down his sentence, Justice Singh noted that the accused did not waste the court’s time or the State‘s resources.
As such, the judge initially sentenced Williams to thirty years in jail for manslaughter, but nine years was taken off the sentence for the time he had already served in prison pending his trial; six years was deducted for the guilty plea and four years because he showed remorse.
The accused was also sentenced to 10 years each for the arson charges. All the sentences will run concurrently.
