After being put off on two occasions because the accused hadn’t a lawyer, all was set for the commencement of the High Court trial of 54-year-old Muntaz Yassim called ‘Joe’ of New Street Cumberland, East Canje, Berbice. Yassim is charged with two counts of Carnal Knowledge.
However, when the matter was called yesterday before Justice James Bovell-Drakes and a mixed jury in the Berbice High Court, the accused was absent.
With both the Prosecutor, attorney at law Renita Singh and defence lawyer Perry Gossai in place, the matter was ready to commence, but the accused was a no show.
Yassim, who was a money lender, is charged with between the 1st January and 22nd December 2006, having carnal knowledge of an 11-year-old girl.
The man is also charged with between 22nd December 2006 and November 2007 at New Street Cumberland, in the county of Berbice, of having carnal knowledge of a 12-year-old girl.
The accused was out on $100,000 bail, and had showed up in court on two occasions, but did not have a lawyer. He was given time and subsequently secured the services of attorney-at-law Gossai.
In court, Justice Bovell -Drakes told the jury that there was a problem on hand since the accused was absent.
In his address to the court, Gossai stated that he spoke to the accused on Tuesday when he contacted him. He was given all assurances that the man would be in court. However he could not give any reason why the man was absent.
Prosecutor Singh asked the court to issue an arrest warrant for Yassim.
The judge subsequently issued an arrest warrant for the accused and put the matter down until next Thursday, December 11, for continuation.
