Three men who were allegedly wounded during a robbery attempt on December 9, 2012 at Betsy Ground, East Canje, Berbice, were on Wednesday freed by Magistrate Sherdel Isaacs Marcus, who ruled that there was insufficient evidence against them.
Those freed were Zaheir Abdul, 22, of New Scheme Adelphi, East Canje Berbice; Keshwar Harrinarine, 32, called “Bread,” of Fyrish, Long Dam; Corentyne and Parmanand Joseph 24, a hire car driver of Johns, Corentyne, Berbice.
A fourth man, identified as Deodat ‘Pop Corn’ Seecharran of Edinburgh, East Bank Berbice, and Adelphi East Canje, Berbice, was slain following another shootout with police.
The accused, who were on six charges each, appeared in the Reliance Magistrate’s court and were represented by Attorney-at-Law Charrandass Persaud.
Police had alleged that the men were captured after a foiled robbery attempt on the house situated at Betsy Ground, East Canje. According to police reports, the suspects were involved in a shootout with police, which ended with three of them being wounded and captured in the St Patrick’s burial ground in Plantation, Rosehall Canje.
Seecharran was shot to his left buttock; Abdul to his left hip and Harrinarine to his right buttock.
Joseph, a driver, was arrested in motor vehicle-HC 1390 in the area. The police recovered a shotgun, pellets, empty casing, boots, caps and jerseys.
The court alleged that on Sunday, December 9, at Rosehall, East Canje, Berbice, the accused shot at police cadet officer Roger Pilgrim with intent to maim, disfigure, disable or cause him grievous bodily harm. They were also charged with discharging a loaded firearm at Police Corporal Randy Hamilton with intent to maim, disfigure, disable or cause him grievous bodily harm. Another charge read that on the same day, the defendants discharged a loaded firearm at Doodnauth Moses with intent to maim, disfigure, disable or cause him grievous bodily harm.
They were also charged with being in possession of a 16-gauge shotgun, three cartridges and a 12-gauge casing without being the holders of firearm licences. The court also alleged that the accused attempted to commit a burglary at the dwelling house of Ragesh Parsram at Betsy Ground, East Canje Berbice.
In his submission, Attorney-at-Law Charrandass Persaud submitted that there was no visual identification of the accused on the charges of attempting to commit a felony, being in possession of firearm, being in possession of ammunition, and discharging a loaded firearm. The attorney also submitted that only one gun was presented to the court; there was no evidence that any of the defendants was using it, and there was no evidence that any gun powder residue was found on the defendants.
According to the attorney, no fingerprints were presented to the court. He also contended that the area where the accused were shot is frequented by a number of persons.
