The jury spent about four hours in deliberations before announcing that they could not reach a unanimous verdict as the Cyon Collier murder trial ended yesterday before Justice Navindra Singh.
Collier who goes by the alias “Picture Boy”, was charged with murdering brothers Ray Walcott called ‘Sugar’, and Carl Andrews, called ‘Alo’ back in 2006. This was the second time that a jury had brought back a “hung jury” for that particular murder.
The mix jury had gone into deliberations shortly before lunch and came out after 16:00hrs yesterday. The forewoman of the jury while addressing the court bowed her head as she read out the decisions of the fellow jurists.
According to her, on the first indictment they were spilt with six guilty and six not guilty. For the second count the vote was eight to four. As a result Justice Singh ordered a retrial into the matter.
Collier was returned to the Camp Street prison shortly after. A look of relief was evident on his face.
Several witnesses testified on behalf of the prosecution, but Amsterdam focused his attention on the prosecution reportedly having no evidence against Collier. Senior State Prosecutor Gildharie-Mursalin highlighted various aspects of the evidence which she opined was adequate for a conviction of the accused.
She refuted that the police evidence was conflicting and said what the officers could not remember was simply “human nature”.
Relatives of the two brothers reacted angrily yesterday as yet another hung jury was announced. According to relatives they noticed various discrepancies during the trial as it related to one particular member of the jury.
For attorney Lyndon Amsterdam, this is the second Cyon Collier trial that resulted in a hung jury. Collier was also on trial last year for the death of Non Pareil businessman Chandrapaul Persaud called ‘Kero man’ who was murdered on September 30, 2006. A retrial had been ordered in that case in November last year.
Prosecutor Judith Gildharie-Mursalin had again represented the state; the presiding Judge was Justice Winston Patterson.
