The way is now clear for the Guyana Cricket Board (GCB) to have its challenge to the decision of the Minister of Culture, Youth and Sports Dr. Frank Anthony dissolving the GCB to be heard in the Caribbean Court of Justice (CCJ).
This follows the ruling yesterday by the CCJ to grant special leave to appeal to the GCB to challenge the decision of the Minister.
The GCB on the 28th December, 2011 had applied through its lawyers Sir Fenton Ramsahoye S.C. and Sanjeev Datadin to the Guyana High Court to have the decision of the Minister quashed as being arbitrary and unlawful. That application was refused by the Acting Chief Justice Ian Chang S.C.
The GCB then renewed its application to the Full Court of the Guyana High Court, their application was again refused. The GCB appealed to the Guyana Court of Appeal that also refused their application.
However, the CCJ in a unanimous decision granted special leave to appeal the decision of the Guyana Court of Appeal saying it found “there exists good and substantial grounds of argument” and fixed the hearing of the appeal for the 29thMay, 2012.
Earlier, at the commencement of the hearing the Court heard from Sir Fenton Ramsahoye S.C. that his clients were being subjected to great pressure from the State and were being asked to withdraw the proceedings against the Attorney General.
He said further that it was a great contempt of Court that the Attorney General was apparently in possession of letters from his clients some of which he did not have or had not seen before the hearing.
The Court commented that it found the allegations most alarming and unsettling especially since the allegations were only belatedly denied by the State. The GCB was permitted to substitute two persons as representatives for the purpose of further conducting the action before the Court.
