A minibus driver, who in 2008 caused the death a motorcyclist, was yesterday fined $75,000 by Magistrate Sueanna Lovell for causing death by dangerous driving and for driving an uninsured vehicle.
Fifty-seven-year-old Dennis Clarke of Lot 239 ‘B’ Field Sophia was required to pay a $75,000 fine for causing the death of Casey McGregor and $25,000 for driving his vehicle which was at the time not insured.
The police said that on October 3, 2008, Clarke drove his vehicle in a dangerous manner colliding with the motorist thereby causing his demise. They claimed that the defendant was driving along Irving Street and failed to stop when he approached Lamaha Street. He collided with the cyclist who at the time was proceeding along the northern side of Lamaha.
As a result of the crash, the deceased suffered injuries about his body. He was taken to the public hospital where he later succumbed.
Clarke faced the court and pleaded not guilty to the offence and was later placed on $200,000 bail. Following a three-year-long trial, the defendant was found guilty after several witnesses had testified in the matter. There was even a witness who testified to being on the scene and had seen what transpired at the time of the accident.
The defendant was represented by Defense Lawyer Roger Yearwood, who requested leniency for the defendant. He told the court that his client was a married man with children and that he was the only breadwinner in his home.
Taking the lawyers request into consideration, the court ordered that the defendant pay the fine.
The court also stressed the importance of safety gear since it was said that the deceased was not wearing his helmet on the day of the accident. He was also said to be on the wrong side of the road.
