Embattled Police Commissioner Henry Greene has said that sex with the woman who is accusing him of
raping her, was consensual.
This revelation was contained in a statement that the commissioner gave to investigators who are now awaiting the advice of the Director of Public Prosecutions, Shalimar Ali-Hack.
Greene has refrained from commenting publicly on the matter, claiming that God will be his judge.
However a well placed source, who is close to the investigation, while offering very little details, said that although the file was sent to the DPP early last week a decision on the matter could take a while, since there are several statements that will have to be perused.
“It is certainly a ticklish matter, especially given the statements of both of the parties involved,” the source said.
The question of consent is certainly a contentious one and the DPP for her part was giving out precious little when contacted by this newspaper on Friday.
“I still have some work to do on the matter. It’s a very thick file and I will have to go through everything.”
The woman who hails from East Coast Demerara, in her statement, had claimed that she had initially visited Greene at his Eve Leary office on November 15 and requested his assistance to recover a cellular phone which was in the police possession in connection with another matter in which she was involved.
She alleged that Greene promised to look into the matter.
The woman returned to Eve Leary six days later and detailed her plight to the Police Commissioner, even outlining her financial plight to him.
“He went down into his drawer and took out some money and he gave it to me. I said ‘Sir, I can’t take your money’. He said ‘Maam listen, take this money, l don’t like to hear about children hungry, I love to help out’,” she had stated.
Later that day, she alleged, Greene invited her to Eve Leary to uplift her phone, and she waited for hours while he was at a meeting before seeing him.
She told investigators that the commissioner subsequently took her to a Broad Street hotel where he had sex with her against her will.
However, the woman further stated that she subsequently met with Greene a few days after and was given another set of money which she accepted.
She claimed that she was initially afraid to speak out since the Commissioner had used threatening language to her.
Investigators will have to establish whether or not force was used by the commissioner to obtain sex if they are to pursue a conviction if the matter goes before the court.
“The issue at the end of the day is the consent. Do you have enough evidence to prove that? You see when the DPP is going to charge, she should have what you call a threshold…because anybody could go and make an allegation. But how do we pass that threshold? There must be a 51 percent likelihood of conviction,” a legal source, who is following the matter, explained.
But he argued that should there not be enough evidence to charge Greene criminally, at least there should be some form of disciplinary actions taken given the position he holds.
“You meet a person through the course of your duties and you carry them off on the second occasion that you meet.
He said that for public officials that is a “no, no”.
This could mean that Greene, who is at present on administrative leave to facilitate the investigation, may not be returning to head the force.
Head of the Presidential Secretariat, Dr. Roger Luncheon, had indicated that there is a possibility that Greene could resume his work as the top cop, should he be exonerated.
“We have to put our foot down on public officials. You must conduct yourself in a certain way because of this office you hold,” the legal source said.
“If you’re holding a public office and a member of the public comes to you they must be free to come and make that complaint,” he added.
He suggested that there is provision in the constitution to discipline the commissioner since the office is a constitutional one.
