After it was indicated to the court that witnesses in three separate matters were unavailable, three men were subsequently sent home after the matters were dismissed.
Calvin Mercurius charged with the possession of a firearm and ammunition; Kevin Jones apprehended for the use of a gun during a robbery; and Ryan Hescott, also charged for robbery with a gun, were yesterday sent home after their matters had been sacked due to the negligence of the police and the time wasted by the magistrate before whom the matter had originally been called.
Acting Chief Magistrate Priya Sewnarine- Beharry released the men after she had realized that the matters against them had not even commenced while the defendants had already spent more than six months in prison.
The magistrate said that the absence of witnesses prohibited the continuation of the matters and thus wasted valuable court time. The magistrate had advised previously that matters should not be left behind and it would be in her discretion to release persons, if the prosecution was not prepared to proceed in the matter.
When the trio was called, no officers or witnesses were present in court although summons had been sent for the persons. It was also revealed that these matters were cases pending in another court sent over to the Chief Magistrate for assistance with the matters.
The trio who were extremely grateful to be released from jail, thanked the magistrate repeatedly. She indicated to the men their luck in the matter and advised them not to bring themselves back before the court.
