Members of the “Bravados Cricket Team” on Saturday evening failed to get an interim injunction from the high court to overturn a decision to disqualify them from the 2011 T10 Kares Tapeball Cricket Competition, which is being run in association with the Guyana Softball League.
Through their Attorney at law Nigel Hughes, the team filed an injunction before his worship Justice James Bovell-Drakes.
The team members in their affidavit of support were seeking damages in excess of $100,000 for breach of contract on or about August 27, 2011.
The team was also seeking to have an injunction restraining the defendants whether by themselves, their servants and/or agents howsoever from holding the finals of the 2011 T 10 Kares Tapeball Cricket Competition, unless and until the team is permitted to participate in the semi finals and finals.
The plaintiffs are Nigel Estriado, Earl Gilkes, Shaeed Gittens, Troy Gonsalves, Harold Baboolall, Joshua Lakhan, Marc Anthony Singh, Alex Culley, Anthony Ifill, Mervin Vyphuis, Leroy Bristol, Seon Sertimer, Jason Andrews and Kevin George. The defendants are Haslim Khan, Leonard Harprashad, and Lance Adams who are all executives of the Guyana Softball League, who were represented by attorney at law Glen Hanoman.
In the affidavit of support the team is claiming that they had submitted the names Nigel Estriado, Earl Gilkes, Shaeed Gittens, Troy Gonsalves, Harold Baboolall, Joshua Lakhan, Marc Anthony Singh, Alex Culley, Anthony Ifill, Mervin Vyphuis, Leroy Bristol, Seon Sertimer, Jason Andrews and Kevin George.
These names, which included Nigel Estriado, according to court documents, were accepted by the defendants.
The team had completed several matches successfully and qualified for the quarter finals.
On August 27, 2011 Nigel Estriado along with the captain were informed that they were disqualified because Estriado’s name was not on the player’s list.
The team says it is protesting that they had submitted Estriado’s name on the list.
By way of letter dated August 31st 2011, the team through its attorney Nigel Hughes, wrote to the defendants protesting the disqualification.
But the defendants failed to respond to the letter.
However, Hanoman argued that there was not enough evidence before the court to grant such an order.
The decision came out shortly after 21:30 hrs on Saturday night.
