Real estate agents Vishnu Kadar and Norbert De Freitas have moved to the courts against well known proprietor Khakhan Ramzan and his wife Bibi Zahora Ramzan after the couple failed to pay the agents commission for selling their property.
According to the “Statement of Claim” in the Affidavit, the Ramzans are the joint owners of Property situated at Lot 131, Block “P” Peters Hall, East Bank Demerara, and in February 2011, by oral agreement the Ramzans retained the services of the agents to sell the said property.
This was agreed upon at a consideration of three percent of the final purchase.
Kaieteur News understands that the agents secured purchaser Paula James for the property in the sum of $33.5 million in an Agreement of Sale and Purchase dated April 4, 2011, where a deposit of $5 million was made to the Ramzans.
The documents went on to say that despite “repeated oral demands and a written demand” dated April 29, 2011, the proprietors failed to pay the agents the agreed sum of three percent of the purchase, on completion of the sale and purchase agreement.
As a result, Kadar and De Freitas have files an “Opposition” under the Deeds Registry Act, C.A.P. 05:01 in the Deeds Registry, in which the agents are alleging that is not competent for the Ramzans to seek transport for the said property referred to and described in the Official Gazette dated June 18, 2011 without first paying the agents the sum of $1,005,000 and without security to the agents’ satisfaction for payment of the said amount.
The Ramzans have ignored the said Oppositions and the sum of $1,005,000 remains due owning and payable.
According to the affidavit verifying the claims, Norbert De Freitas went to the said property and photographed the inside and outside of the building and developed same at his own expenses.
After the sale was concluded Khakhan Ramzan “became mystic” and avoided both agents whenever he saw them. When he was contacted via telephone the man promised Kadar and De Freitas to “bring the said sum” to the agents but he failed to do so.
All documents were shown to this newspaper to verify the information supplied and the scheduled court date is August 3, 2011 at the Supreme Court of Judicature, Civil Jurisdiction (Commercial Division).
