After six years in the High Court contesting the purported Interim Management Committee of the Amalgamated Transport and General Workers Union (ATGWU), Godfrey Whyte, the President of the Union, was granted an injunction by Justice Brassington Reynolds on Monday.
The injunction restrained the defendants who are members of the union, their servants and agents from acting jointly and severally as the Interim Management Committee.
In the court document it was also noted that a request by the defendant for a stay of execution was also denied.
Representing the plaintiff was attorney-at-law Roysdale Fore. On May 30, 2004 the union held its 20th Biennial Delegates conference at its headquarters at 46 Urquhart Street, Georgetown.
In the affidavit it was noted that at the conference several persons, including one Fiona Cheddie, and Marlyn Chee-A-Tow, attempted to disrupt the conference and to depart from the published agenda.
The plaintiff, Godfrey Whyte, who presided over the conference in his capacity as the President, insisted on adhering to the Agenda. He indicated that the Rules made adequate provision for airing the issues the defendants were attempting to air.
However, the defendants refused to cease their efforts to ignore the agenda, leaving the Plaintiff no alternative but to adjourn.
Whyte then instituted legal proceedings and made application for several injunctions to restrain the defendants from holding themselves out as the Interim Management Committee of the Union, from purporting to act for it, and from exercising any functions of the Union and its organs.
This application was made inter-partes by Justice Yonnette Cummings-Edwards on July 6, 2004.
While this was pending, the defendants attempted to reconvene the 20th Biennial Delegates Conference which had been adjourned by the Plaintiff on May 30, 2004, under the auspices of the purported Interim Management Committee.
On November 15, 2004, Justice Winston Patterson issued an Interim Injunction restraining, the Defendants from convening the said Conference.
