Alliance for Change Presidential Candidate Khemraj Ramjattan says that while his party has a problem with the members of the Integrity Commission, given that they were not appointed according to the Law, they will make their declarations.
The Integrity Commission recently reminded persons, who fall under the ambit of persons who need to declare their assets and income, that they have until the final Friday to submit their declarations for the period between 1997 and 2010.
Ramjattan stated that it was a matter of principle and he made his declarations to the Constitutional Office and not to the members of the body.
The AFC Presidential Candidate explained that he could say what he wants about the President as an individual but the Office has to be respected.
Three members of the Integrity Commission were at the end of May 2009 sworn-in by President Bharrat Jagdeo at the Office of the President.
Those sworn-in were Subhadra Sukhi, Nigel Hazel and Fazal Mohamed Feroze.
Feroze said that he and his other two colleagues are happy to serve Guyana and that they are looking forward to the work of the Commission.
He added that they were told that a Chairman for the Commission will be announced within a week, since further consultations have to be done between President Bharrat Jagdeo and Opposition Leader, Robert Corbin.
This is yet to happen.
The Integrity Commission Act, Chapter 19:12 came into effect with the passage of the Integrity Commission Act No 20 of 1997. This law provides for the establishment of a Commission to ensure probity in public life, particularly among elected officials and public officers entrusted with responsibilities by the State.
Under this Law, the designated public officials are required to submit annual returns of their assets and may be subject to penalties if they fail to do so without reasonable cause, (Section 22(a) and 22 (a) i). Among the declarations that are required to be made, are all gifts received by public officials and it is for the Integrity Commission to determine whether those gifts are personal, or, whether they belong to the State. The only exceptions are gifts from relatives.
