A judge has ordered Bel Air Park businessman, Gerry Gouveia, to demolish several structures erected in his Roraima Inn compound following an ex-parte application for a mandatory injunction by his neighbour.
Earlier this month, Toral “Johnny” Kowlessar, who operates Pavnik Press, located next door to Roraima Inn, went to court asking for mandatory orders, claiming that Gouveia illegally constructed several structures, even raising a fence to a height beyond the regulated limits. Kowlessar claimed in court documents that despite acknowledging the infringements, his neighbour refused to remove them.
On Wednesday, last, Justice James Bovell-Drakes, granted the orders, instructing Gouveia to demolish a laundry room, two toilets, a shower room, a pool storage area, a water tank and trestle and water pump, among other things.
The businessman was also ordered to remove electrical poles that were erected on Kowlessar’s premises temporarily but never removed.
In his claims, Kowlessar said that his neighbour has engaged in wanton, unlawful and unreasonable conduct with total disregard to his right to a peaceful and quiet enjoyment of his property.
In addition to roofs sloping down above his property, Kowlessar accused Gouveia of listening to his complaints but failing to act, even going ahead and raising his fence to a height of nine feet.
“Then there were smells from the toilets and noise from a water pump which was activated at all hours of the day,” Kowlessar pointed out.
On December 20, after being unable to speak to Gouveia, Kowlessar claimed that he asked his lawyer to send his neighbour a letter to remove the structures next to the fence, the water pumps and electrical poles within 24 hours.
Kowlessar claimed in court documents filed by his lawyer, Vidyanand Persaud, that Gouveia, despite signaling his intentions via a letter from his own lawyers to work closely with him (Kowlessar) to resolve the issues, accelerated his construction works by raising the fence which was a sore issue, in “gross contravention” to the city’s bylaws.
