An Atlantic Gardens resident charged with the road death of a City Council employee has successfully appealed against a $2M bail granted by Magistrate Judy Latchman earlier this week.
The accused, Shaun Lall, who is also a resident of Canada and of Lot 81 Atlantic Gardens, East Coast Demerara, was granted bail in the sum of $500,000 on a petition by attorney at law Anil Nandlall before Chief Justice Ian Chang yesterday.
Lall was granted bail on the condition that his Passport and Canadian Residency Card remain in Police custody and that he report every Monday at 8:30 am at the Sparendaam Police Station commencing December 20, 2010, until the determination of the charges.
In Lall’s petition to the court through his attorney, it was stated that the bail that was fixed at $2M by Magistrate Judy Latchman was oppressive and unreasonable and that the he has the right to reasonable bail and the presumption of innocence until proven otherwise.
On December 8, Shaun Lall, while driving Honda CRV PJJ 8098, west along the southern carriageway of the Turkeyen Public Road, collided with a pedal cyclist Suresh Sawh, 47, called ‘Ramesh’ of 136, Fourth Street, Mon Repos, East Coast Demerara who was travelling in the same direction; the pedal cyclist was pronounced dead upon arrival at Georgetown Public Hospital Georgetown.
Lall was then charged with causing death by dangerous driving.
In tears, Lilowtie Sawh, the dead man’s wife, said it is less than ten days and the man who was responsible for the death of her husband is walking freely on the road. ‘That is not fair’.
