A 21-year-old miner from Wakapoa, North West District was yesterday not required to plead to the capital offence of murder when he appeared before Acting Chief Magistrate Melissa Robertson.
It was alleged that Seaford Obermuller, on May 23, last at Ikawna Backdam murdered Elson Prince.
Obermuller said that he acted in self defence.
He told the court that on Sunday afternoon he left his home to inspect an engine in the back dam.
The man said he stopped at shop and saw Prince drinking with some friends. He further told the magistrate that he went back to the shop around 17:00hrs to watch a movie. He said that Prince offered him a “shot of vodka’ and he accepted.
Minutes later the man said Prince threw a plate at him. Yesterday he showed the court his injuries to his face.
Obermuller said that he was continuously tormented and provoked by Prince. The court heard that Prince allegedly attacked Obermuller with a spade and a piece of wood on the day in question.
The murder accused said that on May 23, last, Prince lashed him in the head with a piece of wood and that he fell to the floor.
The man told the magistrate that after Prince lashed him with the wood, he fell to the ground and picked up the same wood and attacked Prince.
Obermuller told the magistrate that he left the scene after the incident and later learned that Prince had died.
He was remanded to prison and is expected to make another court on June 23.
