Earl Scott, 33, the man implicated in a stabbing incident at Laing Avenue a few weeks back was yesterday granted his pre trial liberty, after making a court appearance before Acting Chief Magistrate Melissa Robertson.
It was alleged that on May 3, at Laing Avenue, Scott unlawfully and maliciously wounded Ryan Nicolas, with intent to murder him. He was not required to plead since the charge was indictable. Attorneys at law Nigel Hughes and Tanya Warren appeared on his behalf.
Nigel Hughes, who addressed the court, said that Nicolas has a history with his client. The lawyer explained that Nicolas had “shot up” Scott’s home in 2008. He said that the matter was reported but no police action was taken.
According to the lawyer, Nicolas would continuously torment his client, by taunting him.
Hughes further stated that on the day in question his client spoke to a relative of Nicolas and the man became annoyed.
The lawyer opined that it was Nicolas who was the aggressor and that he was stabbed because of his own actions.
At this point Police Prosecutor Stephen Telford interjected and stated that some of the arguments by the defence had some merit.
Telford however said that the prosecution is still objecting to bail, because of the seriousness of the offense.
The prosecutor explained that on the day in questioned Nicolas and Scott had an argument and it was Scott who attacked Nicolas.
He said that Nicolas was stabbed to the region of his heart, face and hands.
The prosecutor said that Nicolas was released five days after his admission to hospital. Telford said that he was instructed that Nicolas requires further treatment.
Hughes in rebuttal to the prosecutor’s statements said that Nicolas does not require further medical attention.
The lawyer explained that a relative of Nicolas tried to retain him as the lawyer on Tuesday afternoon, but Scott already retained him.
Hughes opined that the only reason Nicolas said that he had seek further medical attention was because he was wanted by the police in connection with the shooting incident back in 2008.
The lawyer further argued that his client should be admitted to bail, since Nicolas continuously tormented him.
Hughes said that his client fled because of the fear that Nicolas would have killed him.
The lawyer further argued that the mere fact the police did not respond to a shooting incident two years ago, has contributed to his client losing confidence in the police.
The magistrate granted Scott $500,000 bail and ordered him to return to court on June 13.
On May 4, Nicolas and Scott had a heated fracas, which resulted in Nicolas being stabbed repeatedly.
Celeste Marshall, Nicolas’s reputed wife, had told the media that Scott ran into her mother’s home and stabbed her husband.
