The respondents in the compensation/punitive damages case against Attorney General of Guyana, the Commissioner of Police, and the two ranks implicated in the torture, Sergeant Narine Lall and Mohanram Dolai have been granted three weeks to file a response in the case involving the tortured teenager, Twyon Thomas.
The request was made by a state attorney on behalf of the Attorney General, and the attorney on behalf of Thomas had no objection to the extension and as such it was granted by Justice Roxanne George-Wiltshire on Monday last.
Attorney at law Khemraj Ramjattan has since expressed his surprise at the request for an extension, in light of the fact that culpability for the allegation of torture has already been established.
Ramjattan had earlier expressed confidence that his client would be successful in the bid to secure a sizeable compensation as well as punitive payment by the state, which should be a deterrent in preventing future torture by ranks empowered by the State.
He said that there has already been an admission to the act of torture committed on the young boy, evident by the fact that the two ranks involved have been charged.
Ramjattan said that he is hopeful that the Court Marshals have filed the return of service so as not to prolong the matter.
The lawsuit filed by Ramjattan cites exemplary and/or aggravated damages for oppressive and authoritarian conduct by the respondents during the period of 27th October, 2009 to 31st October, 2009 in West Demerara.
According to a report, following an investigation into the now infamous incident, the ranks covered the teen’s face with a jersey, which was secured around his head with scotch tape.
That process caused him to be partly suffocated and he was told to remove all his clothing after which, he was beaten with a hard object. His hands were then bound in front and he was placed to lie on the floor and beaten on his feet.
During that ordeal, he managed to partly remove the jersey from his face but was simultaneously hit behind his neck by one of the policemen.
The jersey was pulled back over his head and he was dealt a lash with a heavy object to his stomach.
The lad related that on the floor, he felt a cold substance being poured on the region of his genitals and upper part of the thigh, and simultaneously, he felt a burning sensation and he screamed.
He alleged that the ranks removed the jersey and he saw the area of his genitals on fire, which was extinguished by the ranks.
A fan and gel were subsequently provided to him to soothe the burnt area.
Assistant Superintendent of Police Wright was the Duty Officer at Divisional Headquarters, Leonora Police Station at the time and saw Constable Dolai taking a written statement from the teen in the presence of Constable De Souza.
He claimed that around midnight whilst in his Office, he received information from the Operations Room that Thomas who had injuries to his lower abdomen was taken to the Vreed-en-Hoop Police Station.
He said that he instructed Sergeant Clarke and Corporal Foo to visit and examine Thomas but on their return, he was advised that Thomas’s injuries were minor and he had received treatment.
He did not enquire how the teen sustained his injuries, but on reporting the incident to the Divisional Commander, Assistant Commissioner Paulette Morrison, he informed her that Thomas was burnt with methylated spirit and matches by Dolai.
The teen in his sworn affidavit states,” I always feel traumatised since…I am still unable to work…My penis does not work like it used to.”
