Mohammed Khan walked out of the Vreed-en-Hoop Magistrate’s Court a free man yesterday after paying $40,000 in fines for two charges. He, however, could still be charged with causing death by dangerous driving.
Khan, a resident of Sea View, Anna Catherina, West Coast Demerara, was the driver of the Canter truck GLL 8336, which collided with motorcar, HB 5633 that was being driven by Levi Leon Seecharran on July 7 last.
The collision, which occurred on the Versailles Public Road, West Bank Demerara, resulted in the death of 24-year-old Seecharran of 16 Ruimzeight Garden, West Coast Demerara.
Khan, according to reports, had fled the scene of the accident but was eventually detained by police.
Investigations had revealed that Khan, at the time of the accident, was unlicensed and had therefore breached the vehicle’s insurance policy.
Accordingly, he was charged for being unlicensed and for breach of insurance which attracted $25,000 and $15,000 fines respectively.
He first appeared in court last week Friday but was remanded to prison.
Khan appeared before Magistrate Fazil Azeez yesterday who advised him of the fines. The Magistrate also proceeded to asked Khan whether he was in fact driving the vehicle at the time of the accident, a question the man declined to answer.
However, the Magistrate did noted that he had heard speculations that Khan was not the driver of the vehicle but pointed to the fact that he (Khan) had pleaded guilty to the charges that were made against him. The Magistrate also noted that with the relevant evidence the man could have been charged with causing death by dangerous driving.
And since the investigating officer failed to appear in court to bring evidence against Khan, the truck driver was ordered to pay the fines before being allowed his freedom. According to the Magistrate, if Khan had not pleaded guilty he would have dismissed the charges against him.
However, Police Prosecutor Sherwin Matthews, informed this newspaper yesterday that the Police is currently seeking the advice of the Director of Public Prosecutions (DPP) on the matter.
He added that there is a likelihood that Khan could still be charged for causing death by dangerous driving based on the advice of the DPP.
