A timely order by Justice William Ramlal is being hailed as the reason for the excellent performance of one of this year’s National Grade Six Assessment (NGSA) top achievers.
On February 27 last, Justice Ramlal had ordered the ceasing of operations of a furniture manufacturer, located next door to the Non Pareil, East Coast Demerara home of a leading NGSA performer, Somant Heeralall.
His grandfather, Premlall Ramessar, strongly believes that this significantly enhanced the environment for the lad to realise his goal of gaining a place at one of the country’s most prestigious secondary institutions.
Heeralall, who attended Annandale Primary, obtained 560 marks which placed him joint sixth among the thousands who sat the examination in April.
He is now enjoying a holiday in the United States of America and is expected to take up a place at Queen’s College.
Since last year, Somant’s mother, Nirmala Heeralall, had moved to the court seeking an injunction to suspend the operations of the furniture manufacturer since it was posing an environmental threat via noise and dust pollution.
The matter has its genesis in a complaint filed by one of the businessman’s neighbours to the Central Housing and Planning Authority (CH&PA).
Heeralall had sought to have the Ministry of Housing intervene meaningfully in the matter since the transport for the property prohibits any industrial activity in the community.
According to the transport, “no chemical (toxic or non-toxic) shall be stored in the building on the said lot, and the said building shall not be used for any activity of an industrial nature.”
The business had been operating the woodworking establishment for the past four years much to the annoyance of those in close proximity.
This was despite several attempts to have the relevant authorities intervene.
Nirmala Heeralall, a schoolteacher, said she has written to the Environmental Protection Agency, the Central Housing and Planning Authority and the Regional Democratic Council, but nothing was done.
The CH&PA, through its attorney Robert Ramcharran, had also moved to the court to prevent the furniture maker from continuing his operation.
Justice Ramlal then ordered that the businessman cease his operations immediately, unless he obtains the written approval from the CH&PA to operate a furniture workshop at his address.
The judge also ordered that the businessman pay the cost of $25,000, before the filing of any further proceedings in the matter.
Heeralall had explained that apart from the noise generated by the furniture-making establishment, she and her family have had to endure a severe amount of dust and fumes from the spray-painting equipment used by the factory.
“I would like to thank Justice Ramlal for making the timely order because the noise from the workshop used to affect him. The order made by the judge allowed the boy some peace and quiet. All the time the boy used to complain about eye aches. When I carried him to school he used to say, “grandfather my eyes are burning and that is a day after the man would have sprayed his furniture, plus night time the man had no discretion, he was working up to eight and nine, the same time my grandson was studying,” Premlall Ramessar told Kaieteur News.
The 12-year-old was greeted with the news of placing among the country’s top ten just as he was clearing the immigration area at the Cheddi Jagan International Airport, Timehri.
The aspiring doctor said that his hard work during preparation had finally paid off and he would now definitely enjoy his vacation abroad.
Apart from Justice Ramlal, his grandfather expressed gratitude to the boy’s teachers, from playschool to primary level.
He also singled out Mr. and Mrs. Arif of Lusignan, his grandson’s extra lessons teachers.
Also coming in for special mention was Mr. Robert Ramcharran, the attorney for the CH&PA.
“And our lawyers Miss Dhanwantie Sookdeo and Emily Dodson, who worked tirelessly on our case,” Ramessar told this newspaper.
Ramessar said that because of the judge’s order, his grandson has not disappointed.
“He has rewarded us with a place at Queen’s College,” Ramessar said.
