Rambarran Singh, called ‘Kesho’, was yesterday sentenced to death for the murder of his eldest brother Mahadeo Singh, called Shanta Ram.
A 12-member jury arrived at a unanimous verdict of guilty after some three hours of deliberation.
After hearing the verdict, all that Singh opted to tell the court was: “Me ain’t guilty…Me ain’t guilty.”
His attorney, Senior Counsel Bernard De Santos, said that the sentence for murder is not mandatory but is discretionary.
According to him, the court has the power to undertake a procedure to decide which of two alternatives it should impose, namely the death sentence or life imprisonment.
The presiding judge, Brassington Reynolds, imposed the death sentence.
Singh maintained his composure after hearing the sentence and was expressionless. However, his relatives who were present in court appeared surprised at the guilty verdict and the sentence.
This brought to the end an unpredictable trial which was ongoing for the past three weeks. There were nine prosecution witnesses and five defence witnesses.
The prosecution contended that bad relationship over a property led to Rambarran Singh stabbing Mahadeo Singh to death on March 22, 2005 at La Jalousie, West Coast Demerara railway embankment.
The accused allegedly stabbed the victim 21 times.
Singh, in an un-sworn statement to the court, said that he was not at the scene of the crime on the day the incident occurred.
He added that he was in the backdam, and when he was coming out he was met by another of his brothers, who asked him if he had seen Mahadeo that day.
According to him, he replied in the affirmative stating that he had seen him in the backdam earlier in the day.
Subsequently the police arrested him. One of the prosecution witnesses contended that he was under a mango tree and saw Rambarran Singh stab his brother.
The matter was prosecuted by special state prosecutor Jailall Kissoon.
