The jury now has to decide on a verdict after the defence and the state made oral addresses yesterday in the trial of murder accused Clive Gall, who is charged with the June 21, 2007 stabbing death of his son, Clive Gall jr.
Defence counsel Peter Hugh stated in his address that Clive Gall jr. was the aggressor and that his client acted in self defence.
He urged members of the jury to consider that the killing, although it did indeed occur, was not unlawful.
However, state prosecutor Kara Duff-Yehudah dismissed the possibility of the senior Gall having acted in self defence.
She told the jury that the accused was the one who was armed, and questioned how he could have felt that he was in danger when he had the knife.
The prosecutor added that although Gall snr might have been angry, that did not give him the right to inflict multiple stab wounds on his son.
She said that the accused was the aggressor.
On Friday, the prosecution closed its case. Its last witness was Dr. Nehaul Singh, who performed the autopsy on the body of the deceased.
It was found that Clive Gall jnr died from multiple stab wounds. Dr. Singh found four stab wounds on Gall’s body.
Gall’s mother, Pamela McKenzie, his wife, Andrea Gall, and his neighbour Colleen Cupidore had also testified.
The defence led no witnesses.
However, Gall sr. addressed the court. He said that when he got home, his son was in his room and had on the television set with the volume turned up at a high level, and was watching a pornographic movie.
He added that he told him to turn it down, and an argument subsequently ensued.
The two ended up in a scuffle, during which he stabbed Gall jnr twice.
The matter has been adjourned until today for the summing up to the jury by the judge.
The matter is being heard by Justice Winston Patterson.
