The president, Hermon Bholaisingh, and executive of the Guyana Justices of the Peace and Commissioner of Oaths to Affidavits Association is advising members of the profession to cease from indulging in any form of skullduggery or be prepared to be debarred from membership.
They are urging all Justices of the Peace and Commissioner of Oaths to Affidavits to ensure that they strictly and loyally adhere to the stipulations as defined in their respective instruments/Commissions in the execution of their civic duties and functions within their prescribed jurisdictions.
Specifically, whenever a JP or COA has to notarise a document such as an Affidavit, Declaration, or other such document, the JP or COA is legally bound to ensure that the person to whom the document belongs is in fact, the bonafide person signing his/her name on such document and that the said JP or COA witnesses the signature being done thereafter, affixing his/her stamp and own signature thereto.
Also, JPs and COAs were advised not to engage in the practice of preparing documentation that is outside the parameters of their constitutional powers and that in fact, it is exclusively in the domain of certified legal practitioners in the judicial system.
The executive is in receipt of information that some JPs and COAs affix their signature to documents without the person to whom the document belongs being present. Also, at the JP Association’s statutory meeting on Saturday an issue was raised of JPs fleecing persons’ money under the pretext of being marriage officers and performing functions thereof.
However, not all JPs are legal marriage officers and the members of the Association were advised not to get involved in such acts.
