Gordon Hayde, 31, a bus driver, yesterday appeared before Acting Chief Magistrate Melissa Robertson, charged with disturbing the peace by playing loud music.
On Sunday December 28, last, at the Seawall, the defendant, who was approached by police officers, allegedly had in his possession a music box from which loud music emanated.
He pleaded not guilty to the noise nuisance charge.
When asked by Magistrate Robertson what he had to say about the matter, Hayde said that he usually parks his bus at the Sheriff Street Seawall on weekends and plays the music to entertain those enjoying the evening out.
He added that he was not playing his music loudly, since the only means to power his system is his vehicle battery.
He went on to say that the police told him to turn his music down, and he complied.
The prosecution stated that he was warned and asked to manage the volume of his music at reasonable tone.
They added that around 21:00 hrs that very evening at the exact location, they found the defendant once more playing the music at the same tone.
He was arrested and taken to the Kitty Police Station, where he was charged.
Magistrate Robertson asked the accused if he wanted to say anything more, and he said that he didn’t know the police were at the fish shop.
“I am not the only one who plays music out there; there were others doing the same thing that evening,” he said
Magistrate Robertson, noting that the accused was a first time offender, fined him $7,500, the minimum, with an alternative of four months imprisonment.
